PREAMBLE: Contractual Relationship

These Terms and Conditions (“Terms”) govern your access or use, from within the GCC and its territories of the application, websites, content, products, and services (the “Services,” made available by CARA. PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND WETPAINT CREATIVE DIGITAL SOLUTIONS DMCC (thereinafter referred to as “Wetpaint”) OWNER OF CARA. In these Terms, the words “including” and “include” mean “including, but not limited to.”

By accessing or using the Services, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. CARA produced by Wetpaint may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

 

1. Our Services:

At CARA application owned by Wetpaint, our mission is to allow you to create your personal definition of beauty, by browsing through different looks and booking with the salons/freelancers, as well as purchasing beauty products. We try to insure that what we show you is relevant to your previous researches, and that all partnered salons or freelancers are within your location.

The Services comprise mobile applications and related services (the “Application”), which enable users to arrange and schedule appointments, with the salons/freelancers including with third party providers of such services under agreement with WETPAINT CREATIVE DIGITAL SOLUTIONS DMCC (thereinafter referred to as “Wetpaint”) OWNER OF CARA. To that, users can as well purchase products online.

 

2. License to use Cara application produced by Wetpaint:

CARA can be used only in compliance with those Terms. Subject to your compliance with these Terms, CARA application owned by Wetpaint grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, noncommercial use. Any rights not expressly granted herein are reserved by CARA and CARA’s licensors.

When you create a CARA account, you need to make sure that you fill out all information with accuracy. Anyone could use Cara unless they are under 15 of age. Cara application produced by Wetpaint can be downloaded on any electronically device including computer, tablet, and phones. You agree that we may automatically update the software.

 

Restrictions to use License.

You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Cara owned by Wetpaint; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks or the application.

 

3. The Content:

The Services and all rights therein are and shall remain Cara’s property or the property of Cara’s licensors. Neither these Terms nor your use of the Services convey or grant to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner Cara’s company names, logos, product and service names, trademarks or services marks or those of Cara’s licensors.

The content on Cara application owned by Wetpaint acts as the portfolio of the freelancers or salons. CARA allows posting content including photos, videos, and tutorials. Since beauty is subjective, the platform does not allow any sort of comments or likes on any picture.

Other than serving as their portfolio, CARA uploads latest trends and looks as well as tutorials to add additional inspiration.

 

3.1 – Saving and sharing posts

The content available to you can be saved to your profile for future use. To that, you may as well share the posts via different platforms such as WhatsApp, Instagram or Facebook.

 

3.2 – Content selection

The content available to you is chosen according to your gender that has been set at the time you have created your account.

In addition, the posts will be chosen according to previous research that you have made on the application.

 

4. Freelancers

 

4.1 – The freelancers

In order to answer to your comfort and to minimize the time it takes you to go to the salon, CARA provides you with freelancers that have a background in makeup, hair styling, nail expertise and or massage. You will have the option to choose any freelancer you want OR freelancers near you.

 

4.2 – Freelancers background check

Before joining CARA, every freelancer are asked to provide us with accurate and full information about themselves.

 

4.3– Freelancers equipment

Each freelancers have their own equipment collaborating with their own personal brands.

CARA APPLICATION OWNED BY WETPAINT IS NOT HELD RESPONSIBLE FOR ANY ISSUES BETWEEN FREELANCERS AND THEIR RESPECTFUL BRANDS.

As for any metal equipment, freelancers are asked to sanitize all of their tools to avoid any infections. If the client does happen to be infected, the freelancer will have to handle the matter.

In the case of single use tools, the freelancers should throw them away. The client is encouraged to call CARA and inform them if the discharge of any single use material has not been done properly.

 

4.4 – Freelancer schedule

Every freelancer on the application is asked to fill their schedule every day in order to avoid any over lapping in the bookings.

Whenever the freelancer receives a new appointment, he/she has the option to either approve or decline according to their schedule.

CARA APPLICATION OWNED BY WETPAINT IS NOT HELD RESPONSIBLE FOR THE DECISION THE FREELANCER TAKES, AS THIS APPLICATION OFFERS FREEDOM TO FREELANCERS.

 

4.5 – Booking with freelancers

You may choose to book with a freelancer that is nearby, or any freelancer you desire.

Once the time slot is selected and that all other information requested are filled, you shall receive a notification saying that your booking has been done. If the freelancers fails to approve the appointment, Cara will contact them and in this case, you will receive a reconfirmation notification. The process shall not exceed five minutes.

 

4.6 – Finish

In order to proceed to payment, the freelancer should enter their page and press finish. Only then you will receive a notification that says the money has been deducted from your card.

 

5. Salons

 

5.1 – Booking with salons

Upon agreeing to these terms, you are agreeing that CARA application owned by Wetpaint is not held responsible if the desired salon does not have the timing that suits you. The saloons schedule should be filled by the respectful salons.

If you fail to find the time slot desired at any specific salon, CARA will provide you with options of salons that have the same specifications.

 

5.2 – Salons location

Every salon on the CARA application should specify their location on the map. You will therefore have access to the salons near you. You can specify how far you would like the salon to be in the filter widget.

 

5.3 – Booking confirmation with saloons

Once you have selected the salon and time slot, you will receive a notification that indicates that the booking is under process and that CARA would need an additional three minutes to reconfirm the booking with the respectful salon.

THE BOOKING IS NOT COMPLETE UNLESS A CONFIRMATION NOTIFACTION IS SENT TO YOU.

CARA DOES NOT TAKE RESPONSIBILITY THAT HAPPENS WITHIN THE SALON AFTER BEING ACKNOWLEDGED BY THE RECEPTIONIST.

 

5.4 – Ending the booking

In order to proceed to payment, the salon should enter the application and press on finish. Only then you would receive a notification that says payment complete.

Note that any extra services shall be paid at the salon. Cara is only responsible for bookings done through the application.

 

6. E-Commerce

 

6.1 – Third party interference

We grant you a non-transferable and revocable license to use the Site, under the Terms and Conditions described, for the purpose of shopping for personal items sold on the Site. Commercial use or use on behalf of any third party is prohibited. Any breach of these Terms and Conditions shall result in the immediate revocation of the license granted in this paragraph without any prior notice.

 

6.2 – Content provision

Content provided on this site is solely for informational purposes. Product representations expressed on this Site are those of the vendor and are not made by us. Submissions or opinions expressed on this Site are those of the individual posting such content and may not reflect our opinions.

 

6.3 – Promotional e-mails

During the registration process, you agree to receive promotional emails from the application. You can subsequently opt out of receiving such promotional e-mails by clicking on the link at the bottom of any promotional email.

 

6.4 – In-application information

Cara strives to accurately and completely describe its partners products and provide updated information on the Site; however, Cara does not warrant that product descriptions and information on the Site are complete or free from error. This Site may contain general information relating to various conditions and their treatments. Such information is provided for informational purposes only and is not meant to be a substitute for advice provided by an expert or other qualified health care professional. Further, you acknowledge and agree that the views expressed by you and other users as part of the User Content defined on the website/app do not necessarily reflect the views of Cara, and we do not support or endorse any User Content or any other content posted by you or any other user.

 

6.5 – Refusing or cancelling an order

Kindly note that there are cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.

We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price, description or features of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

 

6.6 – Delivery charges

Cara is tied today with a third party company for delivery services, therefore please note that a 10 AED delivery charge will be applicable for all orders below 300 AED.

We accept all types of credit cards, visa and master card. Cash on delivery is only accepted on orders below 1,000 AED and COD fee of 20 AED applies for all COD payment method. To that an additional 25 AED will be charged for same day delivery.

 

7. Allergies

Cosmetics products (such as soaps, lotions, face and eye makeup, fragrances etc…) can provoke allergies reaction in some people. To avoid such irritations to occur, please inform your beautician of any prior allergies you may have. NOR CARA, NOR THE BEAUTY EXPERT WILL BE PENALIZED IF YOU FAIL TO INFORM THEM.

 

8. Prices and payment methods

You understand that use of the Services may result in charges to you for the services you receive (“Charges”). WETPAINT CREATIVE DIGITAL SOLUTIONS DMCC owner OF CARA will receive and/or enable your payment of the applicable Charges for services obtained through your use of the Services.

 

8.1- Prices

The respectful salons or freelancers place all prices that are available to you on Cara application. PLEASE NOTE THAT CARA PRODUCED BY WETPAINT DOES NOT INTERFERE IN THE PRICES.

However, a certain percentage of the prices will go back to the application, in order to always serve you better.

 

8.2 – Payment methods

You are faced with two payment methods: online payment for e-service, and the option of cash on delivery for e-commerce.

 

a- Online payment

Upon agreeing to these terms and conditions, you are agreeing that a security amount can be deducted from your credit card (see data and safety). The payment takes place when you have finished the appointment. When the appointment ends, you will receive a notification that says that money has been deducted from your account.

 

b- COD (Cash on delivery)

For users that do not request putting their credit card online, they could pay in Cash. The amount will directly be handed over to the delivery person. Please note that paying in cash will lead to an additional charge of 20 AED. Cash on delivery will not be applicable for purchases above 1000 AED.

 

9- No show and cancellation policy

 

9.2 – Cancellation policy

2 hours and a half prior to your appointment, you will receive a reminder notification from CARA that will allow you to cancel the appointment or proceed with it. In this case, you will not be charged with a cancellation fee. This will allow the saloon/freelancer to take other appointments and not jeopardize their business.

You will be charged a cancellation fee (7 AED) if you cancel 2 hours or less prior to the booking. These fees pay the time and effort that the freelancer has spent to get to your location.

To view if you have been charged with a cancellation fee; you will need to go to “profile” then “appointments” and check the bill.

In the case where CARA owned by Wetpaint has charged you with a cancellation fee for no apparent reason, you will be able to call the call center who will then refund you.

CARA WILL NOT BE IN CHARGE IF THE SALON TAKES TWO APPOINTMENTS AT THE SAME TIME, IT IS UP TO THE SALON TO ARRANGE THE MATTER.

 

 

9.3 – No show policy

a- Accidents or unpredicted circumstances

In the case where the freelancer fails to show due to an accident or any unpredicted circumstances, you will receive a phone call asking you if it suits you to book you with another freelancer at the same time.

 

b- Unannounced no show

If the freelancer fails to show without announcing it, he/she will get a warning and you will be offered a free makeover. If the same freelancer fails to show up three times, he/she will be removed from the application and pay a penalty of 600 AED.

 

10 – Limitation Of Liability

Cara owned by Wetpaint shall not be liable for any damages, liability or losses arising out of: (i) your use of or reliance on the services or your inability to access or use the services; or (ii) any transaction or relationship between you and any third-party provider, even if Cara has been advised of the possibility of such damages. Cara application produced by Wetpaint shall not be liable for delay or failure in performance resulting from causes beyond Cara’s reasonable control.

Cara shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services, regardless of the negligence (either active, affirmative, sole, or concurrent) of Cara application produced by Wetpaint, even if Cara has been advised of the possibility of such damages including but not limited any damages arising or connected to outbreaks or pandemics including Covid-19 and any claims related thereafter.

The Services may be used by You to request and schedule appointments and bookings and services with third party providers, but you agree that Cara application owned by Wetapint; has no responsibility or liability to you related to any services provided to you by third party providers other than as expressly set forth in these Terms.

 

11- General

You may not assign these Terms without Cara’s prior written approval. Cara application produced and owned by Wetpaint may assign these Terms without your consent to: (i) a subsidiary or affiliate; (ii) an acquirer of Cara’s equity, business or assets; or (iii) a successor by merger. Any purported assignment in violation of this section shall be void. No joint venture, partnership, employment, or agency relationship exists between you, WETPAINT CREATIVE DIGITAL SOLUTIONS DMCC owner CARA or any Third-Party Provider as a result of this Agreement or use of the Services.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. Wetpaint owner of Cara application failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Cara in writing.
